ISSUE: Did the Postal Service violate Article 7.3 by not converting
PTF Robert Greenwell (Grievant) to full time status? If so, what is the
appropriate remedy?
ANALYSIS
In part: ... The main purpose of Article 7.3 is to impose an obligation
on the Postal Service to "maximize the number of full-time employees and
minimize the number of part-time employees."
In accord with Arbitrator Gamser's "standard of practicability" rationale,
the parties are directed to examine the current work environment in tour
1. If PTFs are currently employed on tour 1, the parties shall examine the
records to determine if the PTFs have worked similar number of hours that
the Grievant worked, and if so, the Postal Service shall create a full-time
position to be filled by the senior PTF.
AWARD
The grievance is granted. The Postal Service is directed to take the
aforementioned corrective actions.
